BY ACCESSING OR USING TURBO 3D, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

2.2 Service Availability

  • We strive for 24/7 availability but do not guarantee uninterrupted access
  • We may temporarily suspend the Service for maintenance, updates, or technical issues
  • We reserve the right to modify, discontinue, or restrict access to any feature at any time

2.3 No Guarantees

While we strive for high-quality results:

  • We do not guarantee specific quality, accuracy, or suitability of generated 3D models
  • Results may vary based on input image quality, complexity, and other factors
  • We are not responsible for the usability of generated models for specific purposes

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must:

  • Provide accurate, current, and complete information
  • Maintain and update your information as necessary
  • Create a unique password and keep it confidential
  • Be responsible for all activities under your account

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

We are not liable for losses resulting from unauthorized use of your account.

3.3 Account Restrictions

4. Credits and Payment

  • Credits are purchased through our payment partners: Stripe, PayPal, or Polar.sh
  • Credit pricing and consumption rates are displayed on the Service

4.2 Purchasing Credits

  • Minimum purchase: $5 USD (or equivalent in your currency)
  • Credits are added to your account immediately upon successful payment
  • All purchases are final and non-refundable (see Refund Policy for exceptions)
  • You are responsible for any applicable taxes, fees, or currency conversion charges

4.3 Free Credits

  • New users may receive free trial credits upon registration
  • We may offer weekly or monthly free credits to active users
  • Free credit promotions are subject to change or termination at any time without notice
  • Free credits are subject to the same Terms as purchased credits

4.4 Credit Expiration

  • Credits do not expire unless your account is terminated or deleted
  • Unused credits remain in your account indefinitely while your account is active

4.5 No Refunds

  • Credits are generally non-refundable

  • Unused credits are forfeited upon account deletion

4.6 Pricing Changes

We reserve the right to change credit pricing, conversion costs, or promotional offers at any time. Changes will not affect credits already purchased.

5. Use of Service

5.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for lawful purposes.

5.2 Permitted Uses

  • Generate 3D models from your uploaded images

5.3 Prohibited Uses

You may NOT:

  • Upload images you do not own or have permission to use
  • Upload illegal, offensive, harmful, or inappropriate content (see Acceptable Use Policy)
  • Use the Service to violate any laws, regulations, or third-party rights
  • Attempt to reverse engineer, decompile, or extract source code from the Service
  • Use automated systems (bots, scrapers) to access the Service without authorization
  • Overload, disrupt, or interfere with the Service’s functionality
  • Circumvent security measures or access restrictions
  • Resell, redistribute, or commercialize the Service itself (you may sell generated models)
  • Impersonate others or misrepresent your affiliation

6. Content and Intellectual Property

6.1 Your Content

  • You retain full ownership of images you upload
  • You retain full ownership of 3D models generated from your images
  • By uploading content, you grant us a limited license to process, store, and transmit your content solely to provide the Service

6.2 Generated 3D Models

  • You own the 3D models generated from your images
  • You may use, modify, distribute, and commercialize generated models without restriction
  • We claim no ownership or rights to your generated 3D models

6.3 Your Responsibilities

You represent and warrant that:

  • You own or have permission to upload all content you submit
  • Your content does not infringe upon any third-party rights (copyright, trademark, privacy, etc.)
  • Your content complies with all applicable laws and these Terms

6.4 Our Intellectual Property

The Service, including its software, algorithms, design, trademarks, logos, and content (excluding user-generated content), is owned by Turb3D and protected by intellectual property laws.

You may not:

  • Copy, modify, or create derivative works of the Service
  • Use our trademarks, logos, or branding without written permission
  • Remove or alter any proprietary notices

6.5 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use and incorporate such feedback without compensation or attribution.

9. Disclaimers and Limitation of Liability

9.1 No Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Guarantees of accuracy, reliability, or quality of generated 3D models
  • Uninterrupted, secure, or error-free operation

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR CREDITS IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS LESS
  • WE ARE NOT LIABLE FOR LOSSES RESULTING FROM UNAUTHORIZED ACCESS, DATA BREACHES, SERVICE INTERRUPTIONS, OR THIRD-PARTY ACTIONS

9.3 Indemnification

You agree to indemnify, defend, and hold harmless Turbo 3D, its affiliates, and personnel from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your infringement of third-party rights
  • Your uploaded content

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting [email protected]. All unused credits will be forfeited.

10.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

  • Your account is used for fraudulent, harmful, or illegal activities

  • We discontinue the Service

10.3 Effect of Termination

Upon termination:

  • Unused credits are forfeited
  • You must cease all use of the Service
  • Provisions that by their nature should survive (e.g., indemnification, disclaimers) remain in effect
